Forms relating to Mortgage on a Property

Application to Discharge Mortgage-S121

Form for a mortgagee to formally release land from a mortgage after the debt is fully repaid, under Section 121 of the Registration of Titles Act.

Application to Discharge Mortgage- Section 123

This form is used to request a discharge of a mortgage under Section 123 of the Registration of Titles Act when the mortgagee or their representative is unavailable (e.g., deceased, absent, cannot be found). The applicant must show proof of full payment (to the Accountant General) and provide supporting documents, then execute the declaration before an authorized witness.

Application for Partial Discharge of Mortgage

Form used by a mortgagee to release only part of the land from a mortgage while the rest remains secured, under Section 121 of the Registration of Titles Act.

Application for Foreclosure of Mortgages

This form is used by a mortgagee to apply for a Foreclosure Order when a mortgagor has been in default for at least six months and sale attempts failed to cover the debt. It records applicant details, land description, proof of notices served, auction results, property value, and a statement of account, then is signed and witnessed.

Application to be Registered as the Proprietor of Mortgage

This form is used to apply for registration as the new proprietor of a mortgage or land when ownership has been transferred through a vesting instrument, order, or act. It records details of the current proprietor, the new proprietor, the vesting evidence, mortgage and land details, and is executed with witness or company seal as applicable.

Postponement of Mortgage

This form is used when mortgagees agree to change the priority order of registered mortgages on a property, postponing one mortgage in favor of another. It records property details, parties involved, mortgage specifics, and includes required supporting documents and execution formalities.

Transfer of Mortgage or Lease

This form is used to transfer a registered mortgage, charge, or lease from one party to another, specifying property details, transferor and transferee information, consideration, and supporting documents, with execution formalities for individuals, companies, or attorneys.
